Welcome to QUIVR, operated by The Pink Cookie Shop, LLC (“Company,” “we,” “our,” or “us”). By accessing or using the QUIVR mobile app (“App”), you agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the QUIVR App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms within the App. Your continued use of the App after the posting of changes constitutes your acceptance of such changes.

3. Privacy Policy

4. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

5. Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account information and for any activities or actions under your account.

6. User Conduct

You agree not to use the App for any unlawful purpose or in any way that could harm the App, its users, or the Company. Prohibited activities include, but are not limited to:

• Harassing, threatening, or defrauding other users.
• Distributing viruses or harmful code.
• Violating any applicable laws or regulations.
• Infringing on the rights of others.

7. Content

All content and materials available on the App, including but not limited to text, graphics, images, and other materials (collectively, “App Content”), are created and owned by QUIVR. You acknowledge that you do not have the right to post, share, or store content on the App. All App Content is the property of The Pink Cookie Shop, LLC, and is protected by applicable copyright and trademark law. Any unauthorized use of such content or materials is strictly prohibited.

8. Intellectual Property

All content and materials available on the App, including but not limited to text, graphics, website name, code, images, and logos, are the intellectual property of The Pink Cookie Shop, LLC, and are protected by applicable copyright and trademark law. Any unauthorized use of such content or materials is strictly prohibited.

9. In-App Purchases

The App may offer products and services for purchase (“In-App Purchases”). If you choose to make an In-App Purchase, you agree to pay the applicable fees and taxes. All sales are final, and no refunds will be issued, except as required by law.

10. QUIVR Shop

The QUIVR Shop is an in-app store where users can purchase toys, accessories, and a variety of other e-commerce goods (“Products”). By making a purchase from the QUIVR Shop, you agree to the following terms:

• Product Descriptions: We strive to provide accurate descriptions of the Products. However, we do not warrant that the descriptions are complete, reliable, current, or error-free. If a Product offered in the QUIVR Shop is not as described, your sole remedy is to return it in unused condition.
• Pricing: All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes or shipping and handling charges, which will be added to your total at checkout.
• Shipping: We will ship the Products to the address you provide at checkout. Shipping times and costs vary depending on your location and the shipping method chosen. We are not responsible for any delays caused by the shipping carrier.
• Returns and Refunds: Returned Products must be in their original packaging and unused. After 30 days, no refunds or exchanges will be issued. In the event a Product is faulty, please contact us within 30 days of receipt, and we will provide a replacement or refund at our discretion.
• Warranties: Some Products may come with a manufacturer’s warranty. Please refer to the Product packaging for warranty information. We do not offer any warranties on the Products beyond those provided by the manufacturer.

11. Membership Management

QUIVR offers a basic subscription that will be charged on a monthly or annual basis, depending on your selection. By subscribing, you agree to pay the applicable subscription fees and taxes. Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current period. You may cancel your subscription at any time; however, all payments are non-refundable except as required by law. Upon cancellation, you will continue to have access to the subscription benefits until the end of the current billing period.

Price: $14.99 per month / $159.99 per year
Subscription Management: Subscriptions are managed through www.QUIVR.global. We utilize RevenueCat to manage subscriptions.

12. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by the Company. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

13. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

14. Limitation of Liability

To the fullest extent permitted by law, The Pink Cookie Shop, LLC, its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
